Anotácia:

Diplomová práce je zaměřena na problematiku účastenství. Jejím cílem je zanalyzovat a zhodnotit platnou právní úpravu účastenství v širším smyslu a dalších forem trestné součinnosti. Výklad je zaměřen na základní pojmy, jednotlivé druhy účastenství, jejich trestání a základní zásady, kde je poměrně velký prostor věnován excesu pachatele s uvedenými příklady. Součástí práce je také problematika organizovaného zločinu a další formy trestné součinnosti. Tato část obsahuje výklad se zaměřením na organizovanou skupinu, organizovanou zločineckou skupinu, je zde stručné uvedena problematika agenta provokatéra a také výklad skutkových podstat trestného činu legalizace výnosů z trestné činnosti a dalších vybraných trestných činů představující formy trestné součinnosti.

Abstract:

The diploma thesis is focused on the issue of participation. Its aim is to analyze and evaluate the current legislation on participation in a broader sense and other forms of criminal cooperation. The interpretation is focused on the basic concepts, individual types of participation, their punishment and basic principles, where a relatively large space is devoted to the offender's excess with the given examples. Part of the work is also the issue of organized crime and other forms of criminal cooperation. This part contains an explanation focusing on an organized group, an organized criminal group, there is a brief issue of the agent provocateur and also an explanation of the actus rei of the crime of money laundering and other selected crimes representing forms of crime.
