Effects of the new Administrative Procedure Code for the administrative procedure in the first instance

Abstract:

Tématem diplomové práce jsou důsledky nového správního řádu pro řízení na prvním stupni. Cílem práce je přiblížit průběh prvoinstančního správního řízení a poukázat na hlavní rozdíly mezi předchozí a současnou právní úpravou. První část práce se zabývá začleněním správního práva do systému českého práva, vymezením základních pojmů správního práva procesního a základními zásadami činnosti správních orgánů. V další části práce jsou definovány některé procesně právní instituty a pojmy. Těžiště práce spočívá v podrobném popisu průběhu správního řízení v prvním stupni směrem od obecného správního řízení ke konkrétnímu řízení ve věci udělení státního občanství České republiky. Závěrem práce jsou zhodnoceny klady i zápory platné právní úpravy ve vztahu k rychlosti a efektivnosti prvoinstančního správního řízení.

Abstract:

The topic of this diploma work are the consequences of the new Administrative Procedure Code in the first instance of the proceedings. The aim is to approach the process of the first instance Administrative Procedure Code and point out the main differences between the previous and the current legal regulation. The first part of the work is focusing at the integration of Administrative Law into the Czech legal system, by determining the basic terms of the Administrative Procedural Law, and the fundamental principles of the Administrative Bodies’ activities. The next part of the work defines some of the institutes and concepts of the procedural law. The main focus of this work is the detailed description of the first instance Administrative proceedings, from the general Administrative Procedure towards a specific Administrative Procedure, concerning the conferment of the Citizenship of the Czech Republic. The final part of the work evaluates the positives and negatives of the valid legal regulation in relation to the promptness and efficiency of the first instance Administrative Procedure.
