Methodology of Insurance Fraud Investigation

Abstract:

Napsáním této diplomové práce vnikla přehledná metodika vyšetřování trestního činu pojistného podvodu, kterou můžou využít orgány činné v trestním řízení i studenti zabývající se bezpečnostními studii. Využil jsem dostupné odborné literatury a přidal konkrétní příklady pojistných podvodů vyšetřovaných Policií České republiky. Cílem práce také je porovnání skutečně odhalených pojistných podvodů Policií České republiky s daty České asociace pojišťoven. V práci se věnuji historii pojistného podvodu a právním normám definující pojistný podvod. Dále obecně základům kriminalistiky a kriminalistické charakteristice pojistného podvodu. Práci zakončuje konkrétní příklad vyšetřování pojistného podvodu. Samozřejmě nechybí základní definice pojistných pojmů, které jsou při vyšetřování pojistných podvodů velmi důležité.

Abstract:

By writing of this diploma thesis was created a clear methodology for investigating the crime of insurance fraud, which can be used by law enforcement agencies equally as students engaged in security studies. I used professional literature and added specific examples of insurance fraud investigated by the Police of the Czech Republic. The goal of the thesis is also to compare the actually detected insurance fraud by the Police of the Czech Republic with the data of the Czech Insurance Association. In diploma I follow up with the history of insurance fraud and legal norms dealing with insurance fraud. Furthermore, I wrote about the basics of criminology and criminology characteristics of insurance fraud. The work concludes with a concrete example of insurance fraud investigation. Naturally basic definitions of insurance terms are mentioned, which are very important in the investigation of insurance fraud.
