Criminal-law forms of communist-regime political persecution and its development in the yers of 1945 to 1955

Abstract:

Bakalářská práce se zabývá problematikou politické represe v Československu v prvních deseti letech po skončení druhé světové války. V úvodu se věnuje problematice trestání zločinů a provinění spojených s nacistickou okupaci a dále s prvními případy zneužívání represivních orgánů v politickém boji. Dále se práce věnuje zneužití trestního práva v souvislosti s převzetí moci komunisty v roce 1948. V práci je dále analyzováno zpřísňování trestně právních sankcí v průběhu upevňování komunistického režimu. Porovnány jsou jednotlivé hmotně právní úpravy trestního práva platné ve sledovaném období a změny v rámci rekodifikace. Práce se věnuje i změnám v systému soudnictví a postupnému získání politické moci nad justicí. V další části práce jsou na příkladech několika politických procesů ukázány způsoby, jakými byla politická represe uskutečňována. Závěr práce je věnován snahám o nápravu těch nejzávažnějších případů zneužívání represe a porušování zákonů. Věnuje se problematice provádění rehabilitací a postihu těch, kteří se na nezákonnostech komunistického režimu podíleli.

Abstract:

This bachelor thesis is focused on political repressions in Czechoslovakia in the period of the first ten years after the World War II. The introduction deals with the situation of punishments for crimes and the offence connected to the Nazi occupation and also with the first cases of abusing repressive boards from the political point of view. The abusing of criminal law in a connection with taking control by communists in Czechoslovakia in 1948 is described. The thesis analyses the higher power of trial punishments during the communistic regime. The individual modifications of criminal law valid in that period and changes within recodification are discussed. This thesis shows the changes and the continuous controlling and political power of the judge system. In one chapter of the thesis there are described political repressions on examples of some selected trials. The conclusion is focused on the improvement of the most serious cases relating to abusing of repression and breaking the law. The rehabilitation and ways of the punishment for those who were active and took part in the non-law status of the communistic regime are described in the end of the thesis.
