Problems of assignments of cooperative flats into the private ownership

Abstract:

Téma bakalářské práce je Problematika převodů družstevních bytů do soukromého vlastnictví. Práce je rozvržena do šesti kapitol. Nejprve pojednává o bytové politice a družstevnictví. Dále už je zaměřena na privatizaci družstevních bytů. Zákonná úprava družstev bez rozdílu druhu družstva byla zařazena do obchodního zákoníku. V roce 1992 navíc nabyl platnosti transformační zákon a v roce 1994 zákon o vlastnictví bytů, které bytovým družstvům uložily převést byty do vlastnictví těm členům, kteří si o to ve stanovené lhůtě požádají. Na příkladu konkrétního družstva SBD PS Liberec je poukázáno na problémy související s převody družstevních bytů do vlastnictví členů nájemců družstva. Dále je uveden postup v převodech bytů do vlastnictví členů SBD PS Liberec v rámci zákona o vlastnictví bytů. Ke zjištění zájmu o dokončování privatizace družstevních bytů bylo v jednom z bytových domů provedeno šetření prostřednictvím dotazníku. Mimo jiné bylo také předmětem průzkumu zjistit, zda v domě může vzniknout společenství vlastníků jednotek s právní subjektivitou. V závěru lze říci, že transformační zákon a zákon o vlastnictví bytů bytová družstva poškodily, když jim nařídily převést byty do vlastnictví členů nájemců. Družstva se postupně mění z družstva vlastníka na družstvo pro správu cizího majetku.

Abstract:

The theme of my Bachelor's essay is Problems of assignments of cooperative flats into the private ownership. My work is divided into six parts. Firstly it deals with the housing policy and housing co-operatives. Next it is focused to the privatisation of cooperative flats. The regularization of housing co-operatives, without exception of housing co-operatives, was included in the Commercial Code. The Transformation Code took effect in 1992 and in 1994 the Code about flats ownership. These two Codes enacted to the housing co-operatives assign the flats into the housing cooperatives member's ownership that requests about this in deadline. On example of concrete housing co-opereative SBD PS Liberec is refered to the problems associated with assignments of cooperative flats into the ownership of housing cooperative's member and renters. Further is indicated the process of assignements of cooperative flats into the ownership of housing cooperative's members SBD PS Liberec in frame of Code about flats ownership. It was performed the interest's survey throuhg the questionnaries in some flat-building to find out the interest of privatisation completion. Among others it was the subject of survey to find out if the Owners Associations with legal personality could be establish in the flat-building. At the end it is possible to say that the Transformation Code and the Code about flats ownership invaded the housing co-operatives when it enacted them to assign the flats into the housing co-operative's members and renters. The housing co-operatives are gradually changing from cooperatives of owner to cooperatives for administration of foreign property.
