Developing countries and intellectual property protection in international trade

Abstract:

The aim of this thesis is to map the positions of key actors (coalitions of actors) and their progress in negotiations on trade related aspects of intellectual property rights in international trade. Text will focus on developing countries and their different strategies in negotiation during the Uruguay Round and Doha ministerial conference. General conclusions about the relationship between institutional settings of WTO and actions of the actors should result from this analysis. The thesis will come out of the assumption that developing countries able to influence negotiations on intellectual property protection in international trade due to institutional aspects, but they lack the ability to actively promote their own interests. Linked to this is an assumption that change of the institutional settings in this area is likely to have an impact on the behavior of actors. Developing countries are unable to change existing international commitments on intellectual property protection, therefore they seek to clarify and confirm existing rules. Paradoxically, thus developing countries seek to strengthen the rules that are disadvantageous to them, since it is a way to prevent opportunistic behavior and unilateral actions of developed countries and the possibility of increasing predictability.

Abstract:

Cieľom diplomovej práce bude zmapovanie pozícií aktérov (koalícií aktérov) a ich postupu pri vyjednávaní o obchodných aspektoch práv duševného vlastníctva v medzinárodnom obchode. Pozornosť bude zameraná na rozvojové štáty a ich rozdielne stratégie pri vyjednávaní v Uruguajskom kole a Doha. Z takejto analýzy majú vyplynúť obecnejšie závery o vzťahu medzi inštitucionálnym nastavením WTO a jednaním aktérov. Práca bude vychádzať z predpokladov, že rozvojové štáty dokážu ovplyvňovať negociácie o ochrane duševného vlastníctva v medzinárodnom obchode vďaka inštitucionálnym aspektom, ale chýba im schopnosť samostatne aktívne presadzovať svoje záujmy. S tým súvisí predpoklad, že zmena inštitucionálneho nastavenia v tejto oblasti má dopad na správanie aktérov. Rozvojové štáty nie sú schopné presadiť zmenu existujúcich medzinárodných záväzkov v oblasti ochrany duševného vlastníctva, preto sa snažia vyjasniť a potvrdiť existujúce pravidlá. Paradoxne tak rozvojové štáty usilujú o posilnenie pravidiel, ktoré sú pre ne nevýhodné, keďže to je spôsob ako zabrániť oportunistickému chovaniu a unilaterálnemu postupu rozvinutých štátov a možnosť zvýšiť predvídateľnosť.
