Recognition

Abstract:

Tato bakalářská práce je zaměřena na kriminalistickou metodu zvanou rekognice, která je jedním ze zvláštních důkazních prostředků v trestním řízení. Rekognice je upravena v §104b trestního řádu. Práce vymezuje z pohledu kriminalistiky podrobnou klasifikaci rekognice. Dále pojednává o tom, jaký má vztah k dalším zvláštním důkazním prostředkům, jako je konfrontace, vyšetřovací pokus, kriminalistická rekonstrukce a prověrka na místě činu. Užití rekognice v rámci trestního řízení u mladistvých a dospělých osob. Její historický vývoj u nás v České republice. Rozeberu zde perspektivní a bezprostřední přípravu rekognice. V závěru se budu věnovat taktice provedení, dokumentaci a hodnocení rekognice.

Abstract:

This bachelor thesis is focused on a criminalistic method called a recognition which is one of the special means of proof in criminal proceedings. Recognition is regulated in Article 104b of the Criminal Procedure Code. The thesis deals with the classification of the recognition. Further, it focuses on how it relates to other special means of proof, such as confrontation, investigative attempt, criminalistic reconstruction, and crime scene investigation. Use in criminal proceedings of juveniles and adults. Historical development in the Czech Republic. Perspective and immediate preparation of recognition. Finally, I will devote the last section to tactics of implementation, documentation and evaluation of the recognition.
