The constitutional position of local governments in the Czech Republic

Abstract:

Bakalářská práce je psaná na téma „Ústavní postavení územní samosprávy v ČR“. Úvod stručně ukazuje na hlavní části práce a na důvod jejího psaní. Dále jsou v této práci vymezené základní pojmy, které jsou důležité pro pochopení celého systému územní samosprávy v ČR. Další důležitou částí je vysvětlení činnosti a propojení veřejné správy, státní správy a samosprávy, které jsou dané Ústavou ČR. Větší pozornost je věnovaná historii a vývoji veřejné správy. Jsou zde vymezeny zásadní roky a k nim zásadní ústavy. Důležité je i období po roce 1989, kterému se práce také věnuje. Dále rozebírá vztah územní samosprávy a státní správy. Nedílnou součástí této práce je rozbor samostatné a přenesené působnosti. Přenesená působnost je podrobně vysvětlena u krajů a obcí, které jsou zakotveny v článcích 99 až 105 Ústavy ČR a s ní souvisejících ustanovení. Závěr hodnotí jak je celý systém územní samosprávy v ČR propracovaný a jaký má význam pro praktické využití v reálném životě obcí a krajů. A také to, co by mohlo být do budoucna ještě vylepšeno.

Abstract:

Abstract The topic of the Bachelor thesis is "The constitutional position of local government in the Czech Republic." Introduction is briefly focused into the main parts of the task and the reason of writing. Furthermore, there are defined the basic concepts, the most important for understanding of entire system of local governments in the Czech Republic. Another important part is explaining the operation and interconnection of public administration, state administration and local self-government, which are given by the constitution. Greater attention is devoted to the history and development of public administration. There are specified critical years for fundamental constitution them. This Bachelor thesis is also meaning very important period after 1989. This thesis also analyse the relationship between local self-government and state administration. An integral part of this thesis is the analysis of independent and delegated powers. The delegated power is detail explained in the regions and municipalities, which are enshrined in Articles 99 to 105 of the Constitution of the Republic and its related provisions. Conclusion assesses how the entire systems of local government in the Czech Republic elaborate and what is important for practical use in real life of political subdivisions. Also, what could be improved even more in the future.
