Abstract:
Tématem této diplomové práce je vyšší moc. Práce se zabývá právní povahou a funkcí vyšší moci v kontextu českého soukromého práva. Funkce a povaha vyšší moci je v práci demonstrována primárně za užití zákona 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů a současně za užití přiléhavé judikatury a odborné literatury. The topic of this thesis is force majeure. The thesis deals with the legal nature and function of the force majeure in the context of Czech private law. The function and nature of force majeure is demonstrated in the thesis primarily using Act 89/2012 Coll., Civil Code, as amended, and at the same time using the relevant case law and professional literature.
