Success of a judicial executor in debt recovery

Abstract:

Cílem mé diplomové práce je zhodnotit úspěšnost soudního exekutora při vymáhání pohledávek, zamyslet se nad možnými příčinami zastavování exekucí bez vymoženého plnění a navrhnout změny, které by vymahatelnost pohledávek zvýšily. Úspěšnost soudního exekutora hodnotím prostřednictvím komparace s výkonem rozhodnutí prováděným soudy. V této souvislosti ukazuji, kolik bylo nařízeno exekucí a výkonů rozhodnutí v letech 2002 až 2011, a jak se v těchto letech měnil počet vymožených pohledávek u obou subjektů. V jedné z kapitol této práce se věnuji poslední novele občanského soudního řádu a exekučního řádu, která nabyla účinnosti 1. ledna 2013. Snažím se charakterizovat nejdůležitější změny, které s sebou tato novela přinesla, a jejich vliv na úspěšnost soudního exekutora při vymáhání pohledávek.

Abstract:

The goal of my thesis is to assess the success rate of a court distrainer in the process of enforcement of claims, to consider possible causes of the discontinuance of distraints and that without successful enforcement of payment obligation and to suggest changes, which would increase the enforceability of claims. I assess the success rate of a court distrainer through comparision with an execution of a decision, which is performed by courts. I demonstrate in this context how many distraints and executions of decisions were ordered between 2002 and 2011, and how the number of payment obligations, which were enforced, was changing at both subjects during these years. I follow in one chapter of this thesis the last amendment of the Rules of Civil Procedure and the Distrainment Code, which came into effect on the 1st January 2013. I try to characterize the most important changes, which this amendment brings out, and further their influence on the success rate of a court distrainer in the process of enforcement of claims.
