Collusion on the market of gasoline

Abstract:

Tato diplomová práce si klade za cíl poukázat na náročnost prokázání koluzivního chování. A to na příkladu trhu s pohonnými hmotami prodávanými skrze čerpací stanice, tedy trhu sice s velkým množstvím konkurentů, ale prokazujícím i rysy oligopolní. Práce je členěna na dvě části, první část se zabývá hospodářskou soutěží a konkurencí na trhu z pohledu její ochrany antimonopolním zákonodárstvím a orgány v České republice i Evropské unii, jako modelu nejrozšířenějšího v evropském prostředí. Ale také poukazuje na možnosti jiného vypořádání se vlády s touto problematikou, a to nezasahováním, regulací, či znárodněním celého odvětví. V případě trhu s benzínem je velmi těžké stanovit, zda se jedná o zakázané chování či zcela racionální chování v oligopolní struktuře, proto se jedna kapitola zabývá i chováním účastníků na oligopolním trhu. Druhá, analytická část se pak zaměřuje na vývoj případu podezření z kartelové dohody na českém trhu v roce 2001, kdy se ceny benzínu nevyvíjely stejným směrem jako náklady na jeho výrobu, který ani po 12 letech není uzavřen. Také rozebírá a hodnotí situaci na trhu v České republice v delším časovém horizontu.

Abstract:

This thesis aims to highlight the difficulty of proof of collusive behavior. On the example of the market of fuel sold through service stations, a market with lots of competitors, but also showing features of oligopoly. The work is divided into two parts, the first part deals with competition in the market from the perspective of the protection of antitrust laws and the authorities in the Czech Republic and the European Union as a model most widely used in the European environment. But it also points to the possibility of another settlement with the government on this issue, non-interference, regulation or nationalization of the industry. In the case of the petrol market is very difficult to determine if there is a prohibited behavior or completely rational behavior in oligopolistic structure, so one chapter deals with the behavior of participants in an oligopolistic market. The second analytical part is focused on the development of a case of suspected cartel on the Czech market in 2001, where gasoline prices were not going in the same direction as the cost of production, which after 12 years is not closed. It also analyzes and assesses the situation on the market in the Czech Republic in the longer term.
