Formation of Marriage - Civil Marriage

Abstract:

Manželství je fenomén. Je nutné na něj pohlížet nejen jako na společenskou instituci, ale také jako na instituci právní. Uzavřením manželství se pro snoubence mnohé mění. Vznik manželství má svá zákonná pravidla a podmínky, které musejí být dodrženy. Institut vzniku manželství je jednou z oblastí rodinného práva. Rodinné právo se od 1. ledna 2014 opět stalo nedílnou součástí občanského zákoníku č. 89/2012 Sb. Téma je vysoce aktuální vzhledem ke společenskoprávnímu významu institutu manželství. Aktuálnost je podtržena výraznou změnou právní úpravy. Rodinné právo již není upraveno samostatným zákonem č. 94/1963 Sb., o rodině. Zajímavosti přidává zachování svobodné možnosti výběru formy uzavření sňatku. Cílem práce bude analýza problematiky vzniku manželství podle současné právní úpravy, která je jistě obohacena o nové prvky. Zabývat se budu zákonnými překážkami manželství, okamžikem vzniku manželství, uzavíráním manželství v nestandartních situacích, právními následky uzavření manželství, zdánlivým a neplatným manželstvím a matrikami. Komparativní metoda umožní stanovit shody a rozdíly právních úprav.

Abstract:

Marriage is a phenomenon. It must be viewed not only as a social institution, but also as a legal institution. Many things change for the betrothed by concluding a marital contract. The establishment of a marriage has legal rules and conditions that must be observed. The institution of marriage is one of the areas of family law. On 1 January 2014, family law once again became an integral part of the Civil Code, No. 89/2012 Coll. The topic is highly relevant, given the social and legal significance of the institution of marriage. Its relevance is underlined by the significant changes in the legislation. Family law is no longer governed by the separate law No. 94/1963 Coll., on family. The topic is made more interesting by the freedom to choose the form of marital contract. The aim of this thesis is to analyse the issue of establishing a marriage according to the current legislation, which is certainly enriched by new elements. I will deal with the legal barriers of marriage, the moment at which marriage is established, the conclusion of a marital contract in non-standard situations, the legal consequences of marriage, apparent and invalid marriage, and vital records. The comparative method will make it possible to determine the conformity and differences of the legislation.
