European football dispute resolution in relation to the UEFA Financial Fair Play Regulations

Abstract:

Rigorózní práce je zaměřena na problematiku rozhodování fotbalových sporů, jak v rámci interních řízení sportovních asociací, tak u Mezinárodní sportovní arbitráže, a to v souvislosti s porušením konkrétního souboru pravidel vydaných UEFA, mezinárodní sportovní asociace spravující evropské fotbalové prostředí. Úvodní kapitola pojednává o historii sportu, jeho organizační struktuře, legislativní úpravě a vztazích vyskytujících se ve sportovním prostředí. Ve druhé kapitole je přiblížen vztah sportu a mezinárodněprávního prostředí, spolu s uvedením konceptu lex sportiva. Následující kapitola se věnuje rozhodčímu řízení, jakožto způsobu alternativního řešení sporů. Je popsáno řešení sporů v rámci FAČR, UEFA a FIFA. Poté je představena Mezinárodní sportovní arbitráž v Lausanne, historie, činnost, interní struktura i aktuální otázky kolem její existence. Čtvrtá kapitola se zabývá postavením mezinárodních fotbalových federací, především UEFA, kde je přiblíženo dominantní postavení této fotbalové asociace spolu s jeho potenciálním zneužitím v návaznosti na projekt European Super League. Zmíněn je i vztah UEFA a EU. V páté kapitole jsou nejdříve definovány sportovní normy, a poté jsou představena „kontroverzní“ pravidla UEFA Financial Fair Play Regulations, která v evropském fotbalovém prostředí vzbudila řadu reakcí. Nastíněn je vztah těchto pravidel s unijními normami. FFP se týká i závěrečná kapitola, ve které jsou zmíněny případy jejich porušení ze strany fotbalových klubů a následně i analyzovány nálezy CAS v souvislosti s těmito pravidly UEFA. Součástí této kapitoly je i úvaha o vlivu majetných klubů na fotbalové prostředí, a s tím související schopností těchto klubů hledat mezery v pravidlech vydávaných mezinárodními fotbalovými asociacemi.

Abstract:

The thesis focuses on the issue of football dispute resolution, both in the internal proceedings of sports associations and before Court of arbitration for sport, in connection with the violation of a specific set of rules issued by UEFA, an international sports association governing the european football environment. The introductory chapter describes the history of sport, its organizational structure, legislation and relations occurring in the sports environment. The second chapter deals with the relationship between sport and international law along with an introduction to the concept of lex sportiva. The following chapter is focused on arbitration as a way of alternative dispute resolution. Dispute resolution within the FAČR, UEFA and FIFA is described. Then the Court of Arbitration for Sport in Lausanne, its history, activities, internal structure and current issues regarding its existence are presented. The fourth chapter depicts the position of the international football federations, especially UEFA, where its dominant position is discussed, along with potential abuse of power in connection with the European Super League project. The relationship between UEFA and the EU is also mentioned. In the fifth chapter, sports regulations are firstly defined, and then „controversial“ rules of the UEFA Financial Fair Play Regulations, which have provoked a number of reactions in the European football are introduced. The relationship of these rules with EU law is outlined. The FFP is also covered in the final chapter where selected cases of their violation by football clubs are mentioned and subsequently the CAS findings in connection with the FFP are analyzed. Part of this chapter is also an examination of the influence of wealthy clubs on the football environment and their ability to look for gaps in the rules issued by international football associations.
