Alternative means of equipment criminal matters in criminal proceedings

Abstract:

This work suggest new ways to out-modern facilities merits a criminal case and shows their advantages compared with traditional end of criminal case prosecution. Bachelor thesis contained in six main parts. The first part serves as the starting area for the following sections and addresses the merits of the case in criminal proceedings. The second part contained definitions, types and importance of diversion. The third section discusses the Institute for the conditional suspension of prosecution. The fourth part describes the settlement institute. Part Five Points last departure procedure for an agreement on guilt and punishment. Final sixth section describes the procedure under § 204 of the Penal Code. Each of these often emphasized the importance of departure as a means of ensuring speed, flexibility and fairness of criminal proceedings.

Abstract:

Bakalárska práca poukazuje na nové moderné spôsoby mimosúdneho meritórneho vybavenia trestnej veci a poukazuje ma ich výhody v porovnaní s tradičným spôsobom skončenia trestnej veci podaním obžaloby. Bakalárska práca je obsiahnutá do šiestich hlavných častí. Prvá časť plní funkciu štartovacej plochy pre nasledujúce časti a zaoberá sa meritórnymi rozhodnutiami v trestnom konaní. Druhá časť je obsiahnutá definíciami, druhmi a významom jednotlivých odklonov. Tretia časť rozoberá inštitút podmienečného zastavením trestného stíhania. Štvrtá časť charakterizuje inštitút zmieru. Piata časť poukazuje na najnovší odklon konanie o dohode o vine a treste. Finálna šiesta časť charakterizuje konanie podľa § 204 Trestného poriadku. Každá z uvedených častí zdôrazňuje význam odklonov ako prostriedkov zabezpečenia rýchlosti, flexibility a objektívnosti trestného konania.
