Limits of copyright protection of computer programs

Abstract:

Tato práce se zabývá limity autorského práva autora počítačového programu. Na úvod vysvětluje některé pojmy z informatiky související s danou problematikou a shrnuje právní úpravu autorskoprávní ochrany počítačových programů. Věnuje se obecným a zvláštními limitům autorského práva s cílem vymezit pomocí těchto limitů obsah práv autora k počítačovému programu. Je zde kriticky analyzován současný stav právní úpravy i s přihlédnutím k dostupné judikatuře, identifiková-ny problémy této právní úpravy, diskutováno, zda současná právní úprava odpoví-dá technické realitě a nastíněny úvahy de lege ferenda.

Abstract:

This work deals with the limitations of the copyright law of the computer program author. In the beginning, basic terms from informatics are described, together with copyright protection of comuputer programs. It is about general and special limitations of copyright protection of computer programs with the aim of defining the content of the author’s rights using these limitations. The current state of le-gislation is critically analyzed with consideration of available case-law, problems of the legislative are identified, compliance of the current legislative with technical reality is discussed and de lege ferenda thoughts are outlined.
