Conditional discharge from the execution of the punishment from the point of view of the convict

Abstract:

Rigorózní práce se věnuje podmíněnému propuštění z výkonu trestu odnětí svobody jakožto mimořádnému institutu zmírňujícímu nepodmíněný trest odnětí svobody, který byl pravomocným rozhodnutím soudu odsouzenému uložen. Autor vychází z právní úpravy jak hmotně, tak procesně právní. Práce se věnuje převážně žádosti o předčasné propuštění podané odsouzeným a jejímu individuálnímu posuzování z hlediska splnění podmínek a smyslu tohoto trestněprávního institutu. Práce pokrývá postup již od fáze zvažování a následného vypracování návrhu odsouzeného na podmínečné propuštění přes samotný proces veřejného zasedání, dokazování, hodnocení splnění podmínek, zakončený rozhodováním soudu o podmíněném propuštění až po následné soudní rozhodování po uplynutí zkušební doby o tom, zda se podmínečně propuštěný na svobodě osvědčil, či nikoliv. Autor se dále zabývá následnou resocializací odsouzeného, jemu stanovenou zkušební dobou a dalšími omezeními jako hrozbou opětovného pokračování výkonu trestu pro případ neosvědčení se. Pozornost je též věnována činnosti probačních orgánů, případně i zájmových sdružení.

Abstract:

The doctoral thesis aims to analyse conditional discharge from the execution of the punishment as an exceptional institute, that mitigates unconditional charge of imprisonment, that was inflicted by an effective ruling of the court. The author considers both material and procedural legal regulations. The study deals with an application of the convicted for a premature discharge and with an individual assessment of such application based on the given criteria and intention of this institute of criminal law. The study covers all the processes from the very first phase of application consideration, followed by the motion for conditional discharge, open hearing in court, substantiation of the facts, assessment of inflicted conditions and the court decision. The closing phase being the court decision after the probation expiration where it needs to be considered whether the convicted proved his capability.The author analyses the resocialisation of the convicted, probation period and further limitations imposed upon him/her.The above-mentioned are to deter the convicted with further execution of the punishment. The author also takes into consideration activities of the probation authorities and interest groups.
