Higher Power and its Impact on Contract Law

Abstract:

Jak již název napovídá, práce se věnuje vyšší moci a jejímu vlivu na smluvní právo. Na začátku je vysvětlen a vymezen pojem vyšší moc a nastíněna jeho předchozí právní úprava. Samotná bakalářská práce je napsána v režimu zákona č.89/2012 Sb., tudíž se další části již věnují vlivu vyšší moci na vybrané smluvní instituty dle tohoto právního předpisu, kterými je závdavek, náhrada škody a promlčecí lhůta. Krátce je nastíněn i vliv na další instituty, u kterých se dovozují následky způsobení vyšší moci. Cílem práce je vytvořit obecný návrh, nebo návod v rámci smluvní dispozitivnosti, na tvorbu smluvní doložky vyšší moci.

Abstract:

Like the title suggests, this work is dedicated to the higher power and its impact on the contract law. At the beginning of the work, there a concept of the higher power is explained, defined and outlined its previous legislation. The bachelor thesis is written under the Law No. 89/2012 Coll., so the other parts of the work has been devoted to the impact of the higher power on selected contract institutes under this legislation, that is are the earnest, the damages and the limitation period. There is briefly outlined the impact on the other institutions, where the consequences of higher power are deduced. The main aim of this work is, to create a general draft or an instruction under contractual dispositive, on the creation of a higher power contractual clause.
