Tax Ensuring

Abstract:

Bakalářská práce se věnuje jednotlivým postupům správce daně při zajištění daně, a to se zaměřením na vazbu zajišťovacího řízení s řízením o stanovení daně včetně hodnocení možných dopadů postupů správce daně při zajištění daně do majetkové sféry poplatníka. Práce obsahuje analýzu podmínek pro aplikaci institutu zajištění daně správcem daně, včetně omezení spojených s použitím zajišťovacích příkazů v praxi správce daně. Na závěr práce obsahuje vyhodnocení poznatků a náměty vycházející z analýzy dané problematiky s návrhy možných změn v procesním daňovém právu České republiky.

Abstract:

The thesis deals with the particular tax administrator procedures in security tax payment. It is focused on the link between the hedge procedures with the tax assessment procedures together with the evaluation possible impacts of the tax administrator procedures while securing the tax on the taxpayer´s property. The thesis contains the analysis of conditions for application of this institute by the tax administrator including limitations related to the use of hedge commands in practice of the tax administrator. Finally, the thesis contains evaluation of the knowledge and ideas based on the analysis of the issue together with the suggestions for possible changes of legislation in the Czech Republic.
