The position and competence of president in the contitutional system of the Czech Republic and other selected states

Abstract:

Předkládaný text se zabývá komparativním rozborem Ústavního postavení prezidenta ve vybraných státech. Nejvyšší důraz je kladen na právní rozbor postavení prezidenta v ČR. U jednotlivých pravomocí a kompetencí jsou naznačeny meze a limity. Jako srovnávací rámec jsou zvoleny rozbory postavení prezidentů v poloprezidentském a prezidentském systému. Díky úvahám srovnávacího charakteru je připojena i řada návrhu de lege ferenda pro český právní řád. Text se nevyhýbá ani citování z odůvodnění soudních rozsudků. Tím je popis zákonných institutů obohacen o nový rozměr, kterým je střet teoretických závěrů s praxí často určovanou soudními rozhodnutími. Mezi prameny použitými pro vypracování této práce byla v omezeném rozsahu použita i cizojazyčná odborná literatura. Ke stěžejním česky psaným pramenům má funkci subsidiární.

Abstract:

The text deals with a comparative constitutional analysis of the position of president in selected states. The emphasis is placed on analysis of the legal position of the president in ČR. Various powers and responsibilities with the limits of limits are outlined. As a framework for comparative analysis of the position of ČR president are chosen: semi- presidents and presidential system. Due to considerations of comparative nature is attached a number of proposals de lege ferenda point of view for the Czech legal order. The text doesn´t avoid quoting from the grounds of judicial judgments. This is a description of the legal institutes enriched of a new dimension, which concludes from the conflict of theory with practice represented with judicial decisions. Among the sources used for the preparation of this work was applied to a limited extent foreign languages literature. But the key sources are in Czech the foreign are just subsidiary.
