Criminal Liability in Medical Law

Abstract:

Téma diplomové práce jsem si vybrala Trestněprávní odpovědnost ve zdravotnictví. Cílem diplomové práce je seznámit čtenáře s touto problematikou a vymezit hranice, kdy jde o trestněprávní odpovědnost a kdy nikoliv. Hlavním pramenem, ze kterého jsem čerpala, byl zákon č. 40/2009 Sb., trestní zákoník. Diplomová práce je rozdělena do sedmi kapitol, kdy první a poslední kapitolu tvoří úvod a závěr. V úvodu jsou vymezeny stanovené cíle práce a důvody výběru tématu. Následující kapitola se nazývá odpovědnost ve zdravotnictví. Zde jsem nejprve definovala samotnou právní odpovědnost a následně popsala jednotlivé druhy odpovědnosti ve zdravotnictví. Hlavním bodem této kapitoly je trestněprávní odpovědnost. Další kapitola představuje okolnosti vylučující protiprávnost, jež upravuje trestní zákoník a každá z nich je rozebrána. Čtvrtá kapitola představuje instituty z medicínského práva a definuje pojem lege artis. Následující kapitola vymezuje jednotlivé trestné činy, které mohou být spáchány ve zdravotnictví, konkrétně jsem se zaměřila na trestné činy proti životu a zdraví. Šestá kapitola popisuje čtyři reálné případy ze soudní praxe, a proto si myslím, že se jedná o nejzajímavější část diplomové práce. Pro porovnání s českou judikaturou je uveden i soudní případ ze zahraničí. V závěrečné kapitole jsou shrnuty cíle diplomové práce, získané poznatky při zpracování a můj závěrečný názor na problematiku.

Abstract:

As the topic of my diploma thesis I chose Criminal liability in Medical Law. The aim of this thesis is to inform the reader about this issue and to define the boundaries of criminal liability. The main source of the thesis is Act No. 40/2009 Coll., The Criminal Code. The thesis is divided into seven chapters, where the first and the last chapter are Introduction and Conclusion. The Introduction defines the set of goals and reasons for the topic selection. The following chapter is called Health Responsibility. Here I have first defined the legal responsibility and then described the different types of responsibilities in health care. The main point of this chapter is the criminal liability. The next chapter presents the circumstances excluding illegality that ares regulated by the Criminal Code and each of them is described. The fourth chapter introduces institutes of medical law and defines the term lege artis. The following chapter outlines the various crimes that can be committed in the health sector, specifically focusing on crimes against life and health. The sixth chapter describes four real cases from the judicial practice. I think this is the most interesting part of the thesis. For a comparison with Czech case law, a case from abroad is also mentioned. The final chapter summarizes the objectives of the thesis, gained knowledge and my final opinion on the issue.
