Legislation of the customs value as a basis for assessment of duty

Abstract:

Ve své diplomové práci jsem nejprve obecně vymezil postavení celního práva, jehož součástí je i institut celní hodnoty zboží, v systému práva České republiky (kapitola 2). V další části práce (kapitola 3.1.) pojednávám o významu procesu celního hodnocení a jeho vlivu na základní funkce cla, jakož i jeho vztahu k dani z přidané hodnoty. Hlavní a nosnou částí práce je pak osvětlení a představení současné právní úpravy celní hodnoty zboží včetně úpravy metod jejího určování, tak jak jsou následně i aplikovány Celní správou České republiky (kapitola 3.2. a 4). Část práce (kapitola 6) je také věnována určitým zvláštnostem a odlišnostem celního hodnocení v případě určování celní hodnoty u nosičů informací a produktů informační technologie, jakož i u zboží podléhajícího rychlé zkáze. Práce si také všímá některých specifik celního hodnocení v souvislosti s některými celními režimy, zejména celními režimy s hospodářským účinkem (kapitola 7). Pro bližší pochopení předmětné problematiky čtenářem jsem uvedl některé praktické příklady stanovování celní hodnoty zboží. Ve své práci popisuji i pro účely celního hodnocení pravidla pro přepočet částek vyjádřených v cizí měně na zákonnou měnovou jednotku České republiky, kterou je koruna česká (kapitola 5). V jedné z kapitol své diplomové práce (kapitola 8) se věnuji též způsobu jak je celní hodnota zboží deklarantem celnímu úřadu deklarována a prohlašována. Jedna ze závěrečných kapitol práce (kapitola 9) popisuje postup celních orgánů České republiky při řízení o odmítnutí deklarantem prohlašované celní hodnoty a o některých souvisejících povinnostech deklaranta. Závěr práce (kapitola 10) jsem věnoval zhodnocení současné právní úpravy celní hodnoty zboží a vyslovení, podle mého názoru, i některých námětů na zlepšení systému celního hodnocení, a to zejména s přihlédnutím k následnému fiskálnímu efektu pro státní rozpočet.

Abstract:

In my thesis, I first defined in general the position of the customs law whose part is also the institute of the customs value of goods in the law system of the Czech Republic (chapter 2). In the next part of the thesis (chapter 3.1) I deal with the meaning of the process of customs evaluation and its influence on the basis functions of customs, as well as its relation to value added tax. The main and bearing part of the thesis is an explanation and presentation of the current legal regulation of the customs value of goods, including the modification of methods of its setting as they are subsequently applied by the Customs Administration of the Czech Republic (chapters 3.2 and 4). One part of the thesis (chapters 6) is also dedicated to certain peculiarities and differences in customs evaluation when the customs value is set for information carriers and products of information technology, as well as for fast deteriorating goods. The thesis also notes some specifics of customs evaluation in relation to some customs regimes, especially customs regimes with economic impact (chapter 7). To make the given issue more understandable for readers, I included practical examples of the setting of the customs value of goods. For the purposes of customs evaluation, I describe in my thesis the rules for conversion of amounts expressed in foreign currencies to the legal monetary unit of the Czech Republic, which is the Czech crown (chapter 5). In one of the chapters of my thesis (chapter 8) I also describe the method of how the customs value is declared and stated to the Customs Office by the declarant. One of the closing chapters of my thesis (chapter 9) describes the procedure used by the customs bodies of the Czech Republic during proceedings on rejecting the customs value stated by the declarant and on some related duties of the declarant. I dedicated the conclusion of my thesis (chapter 10) to the evaluation of the current legal regulation of the customs value of goods, and to present ? in my opinion ? some topics for the improvement of the customs evaluation system, in particular in view of the subsequent fiscal effect on the state budget.
