International Commercial Relations Between Subjects in Civil Aviation

Abstract:

Cílem bakalářské práce je přiblížit oblast leteckého práva v oblasti obchodně právních vztahů subjektů civilního letectví, zejména mezi leteckými dopravci, leteckými společnostmi a letišti jako provozovateli leteckých služeb a ostatními podniky, podnikajícími v oblasti letecké dopravy. Pokud jde o obecné zásady práva a prameny práva v letecké dopravě, zvláštní pozornost je věnována systému regulace mezinárodního letectví. Letecký dopravce jako poskytovatel služeb v oboru letecké dopravy má postavení významného právního subjektu podnikajícího v oboru, který čelí velkému tlaku konkurence na mezinárodním poli a činnosti podnikání jsou ovlivněny právní legislativou mezinárodního práva soukromého a veřejného. Právo Evropské unie v současné době ovlivňuje celé postavení leteckého průmyslu a oboru letecké dopravy přímou aplikací nařízení jako sekundárního pramene práva Evropské unie do leteckého práva. Letecká doprava je založena na bázi obchodní, provozní, technické, technologické i bezpečnostní spolupráce leteckých dopravců. Letecké společnosti rozvíjejí mezinárodně obchodně právní vztahy zejména na základě uzavíraných obchodně-provozních smluv - multilaterálních a bilaterálních. Specifickou roli v mezinárodní letecké dopravě zaujímají globální aliance s cílem globalizace nabízených produktů leteckých přepravních služeb. Letiště jako podnikatelské subjekty také zabezpečují komerční aktivity a uzavírají různé typy smluv - zejména nájemní smlouvy, smlouvy na poskytování provozních služeb, handlingové smlouvy a smlouvy týkající se údržby techniky a letadel. Letiště uzavírají také kupní smlouvy a outsourcingové smlouvy se subjekty specializující se na různé druhy služeb vyžadující potřebné certifikáty a osvědčení z oblasti civilního letectví např. na údržbu letadlové techniky, informační technologie, catering, security marketingu a public relations. U letišť je konkurence také vysoká, což je dáno překrytím oblastí poptávky po letecké dopravě. Letiště nabízí leteckým společnostem všechny typy provozní a technické spolupráce, profituje z obchodních činností. Letiště uzavírají obchodně právní vztahy s cílem zajištění bezpečného provozu s ekonomickým růstem a vysokou úrovní dopravní obslužnosti v rámci spádové oblasti pro jednotlivé cílové skupiny cestujících. Letecké společnosti musí čelit silnému konkurenčnímu prostředí a nabízet letecká spojení poskytovaná dopravci s výhodnou tarifní a cenovou politikou. Ostatní letecké podniky zvyšují kvalitu nabízených služeb ve spolupráci s letišti a leteckými společnostmi. Bakalářská práce potvrdila hypotézu, že veškeré subjekty civilního letectví včetně leteckých společností podléhají vysoké konkurenci, přičemž principy mezinárodního práva soukromého a veřejného mají zásadní vliv v oblasti civilního letectví. Dále je činnost leteckých podniků ovlivňována přímou aplikací práva Evropské unie. Tato skutečnost umožňuje rozvoj obchodně-právních vztahů a vzájemné spolupráce v letecké dopravě. Při vypracování práce jsou použity metody: analýza, syntéza a metoda deskriptivní. Metoda deskriptivní je aplikována více v úvodních částech práce týkajících se obecných poznatků z mezinárodního práva veřejného a soukromého. Analýza je použita k popisu současné situace leteckých dopravců jako provozovatelů služeb a jejich postavení ve vztahu k letišti a přepravnímu procesu. Syntéza se objevuje v závěrečné části práce shrnující základní fakta a obchodně právní vztahy mezi subjekty civilního letectví.

Abstract:

The aim of my bachelor thesis is to specify aviation law in the area of commercial-legal relations among entities in civil aviation, particularly among air carriers, airlines and airport operators as well as air service operators and other companies doing business in aviation. In respect of the general principles of law and law sources in air transport specific attention is paid to the system of regulation in international aviation. The air carrier as a service provider in the field of air transport has a significant position as a legal entity doing business in a branch facing strong competitive pressure in the international area and business activities are affected by law legislative of private and public international law. The European Union law currently influences the position of aerospace and aviation industry by direct application of the secondary source of the European Union law into the system of aviation law. Air transport is based on commercial, operational, technical, technological and security cooperation of air carriers. Airlines develop international commercial-legal relations especialy according to commercial-operational agreements – multirateral and bilateral. Specific form of cooperation in the international air transport is represented by global alliances with the aim of globalization of offered products in aviation transport services. Airports as business entities also ensure commercial activities and conclude various forms of agreements, especialy lease contracts, contracts for the provision of operational services, handling agreements and other agreements related to the maintenance of aircraft. Airports also conclude the purchase contracts and outsourcing contracts with entities specializing in different sorts of services requiring certificates in civil aviation e.g. aircraft technology maintenance, information technology, catering, security, marketing and public relations. Competition among airports is also strong due to overlapping territories of catchment area of passengers and related demand of air transport. Airports provide operational and technical cooperation with airlines and profit from commercial activities. Airports develop commercial-legal relations with the target to ensure safe standard of operation with the economic increase and high transport serviceability in the catchment area for specific groups of passengers. Airlines must face high level of competition and offer flight connections provided by air carriers with available tariff and price politicy. Other aviation entities contribute the quality of services offered in cooperation with airports and airlines. My bachelor thesis confirmed the hypothesis that all entities of the civil aviation including airlines are subjects of intensive competition and the principles of private and public international law have a major impact on the field of civil aviation. Operation of aviation entities is influenced by the direct application of the European Union law. This fact allows development of commercial-legal relations and mutual cooperation in air transport. Work methods for this bachelor thesis are used: analysis, synthesis and descriptive method. The descriptive method is applied more in the introductory chapters of the thesis related to the general knowledge from the private and public international law. Analysis is used to describe current situation of air carriers as service providers and their position in relation to the airport and transport process. Synthesis in the final part of the bachelor thesis summarizes the basic facts and commercial-legal relations between entities in civil aviation.
