Abstract:
Tato rigorózní práce přináší ucelenou analýzu souladu plain packagingu se závazky států plynoucími z vybraných mezinárodních smluv a s právem EU. Nejprve je posouzen soulad s dohodami uzavřenými v rámci Světové obchodní organizace, tedy zejména se smlouvami přijatými k ochraně duševního vlastnictví – Dohodou TRIPS a jejím prostřednictvím i Pařížskou úmluvou – a dále se smlouvami, které regulují mezinárodní …more
Abstract:
The thesis offers a comprehensive analysis of compatibility of plain packaging schemes with international agreements and EU law. Firstly, focus is given to obligations imposed on states within the WTO system, primarily on TRIPS Agreement and by its virtue also on Paris Convention, as well as on GATT and TBT Agreements.
