Administrative Punishment in Business Activities

Abstract:

Hlavním cílem této práce bylo pokusit se přiblížit běžnému podnikateli možnosti sankčních postihů ze strany živnostenských úřadů, postupy správního orgánu při řešení jednotlivých druhů správních deliktů, případně objasnit jakými úvahami a podklady se správní orgán zabývá při zvažování výše příslušné sankce. Dalším cílem této práce byla snaha o podání uceleného rozboru této problematiky a vlastní zhodnocení současné právní úpravy týkající se správního trestání na úseku živnostenského podnikání a navrhnutí případné novelizace určitých ustanovení živnostenského zákona. V jedné z kapitol je popsané správní trestání na úseku živnostenského podnikání. Jedná se o poměrně specifickou oblast správního trestání, která spočívá především v uložení správně-právní sankce v případě spáchání správního deliktu na úseku podnikání. Tato kapitola se zaměřuje zejména na přestupky podle přestupkového a živnostenského zákona a dále na tzv. jiné správní delikty, konkrétně na správní delikty právnických a podnikajících fyzických osob. Rovněž je v této práci zmíněna kontrolní a dozorová činnost v praxi živnostenských úřadů a právní úprava této problematiky v zahraničí.

Abstract:

The main target of this theses was to try to bring an ordinary businessman near to the possibilities of punitive sanction from the trade offices while dealing with single cases of administrative delicts, as well as to clarify the reasoning and the material that an administrative body takes into consideration when deciding about the amount of the specific penalty. Another target of this theses was the effort of filing a complete analysis of this issue and to bring my own evaluation of the current legislation connected with the administrative punishing in the area of skilled trades and the suggestion of a novelisation of certain provisions of the trade act. In one of the chapters the administrative punishment in the area of skilled trans is described. This is a fairly specific area of administrative punishment, which consists mainly in imposition of administrative sanctions in case of committing administrative delict in the area of business. I tis focused especially on the offences according to the law on offences and the trade law and further on the so-called other administrative delicti, specifically on the administrative delicti of a legal person and a physical person practising a business. Also the inspection and supervision aktivity in the practice of the trade office sis mentioned and the legislation of this issue abroad.
