Rights and Obligations of Domestic Violence Victims and Offenders

Abstract:

Práce se zabývá problematikou domácího násilí v trestním právu se zaměřením na situaci oběti a pachatele, jejich vzájemný vztah, jejich práva a povinnosti v různých fázích trestního řízení. Vztah oběti a pachatele je zasazen do rámce psychologických a kriminalistických poznatků, které jsou významné pro porozumění specifického charakteru domácího násilí. Klíčová práva, povinnosti jsou porovnány se zahraničními úpravami. Současná právní úprava je na závěr vyhodnocena z hlediska své adekvátnosti a dostatečnosti, na což navazují návrhy de lege ferenda.

Abstract:

This thesis addresses issues regarding domestic violence in criminal law. It centers around the situations of victim and offender, their mutual relationship, and their rights and obligations in various phases of criminal procedure. The relationship between victim and offender is laid out in the framework of psychologist and criminalist sets of knowledge, as these are essential to understanding the specific character of domestic violence. The keywords and obligations are compared to foreign legal systems. The current legal system is, at the end, being evaluated from the perspective of its relevance and sufficiency, and this evaluation is being followed up by suggestions de lege ferenda.
