Choice of Law and Its Limitations

Abstract:

The subject of submitted thesis: „Choice of Law and Its Limitation“ is analysis of tools for choice of law and its limitations, as well as application of choice of law on selected Union legislations. Introductory chapter is devoted to the historical development of choice of law since the 16th century until the second half of the 20th century. The following section is devoted to the classification of choice of law. The fourth part analyzes the current position of choice of law in Rome I Regulation and the Rome Convention. The last section contains limitations on the choice of law and examples of limitations in selected Union legislations.

Abstract:

Predmetom bakalárskej práce „Voľba práva a jej obmedzenia“ je analýza inštitútu voľby práva a jeho obmedzení, ako aj aplikácia voľby práva na vybrané úniové predpisy. Úvodná kapitola je venovaná historickému vývoju voľby práva od 16. storočia až druhú polovicu 20. storočia. Nasledujúca časť je venovaná klasifikácii voľby práva. Štvrtá časť analyzuje voľbu práva v nariadení Rím I a Rímskom dohovore. Posledná časť obsahuje teóriu obmedzenia voľby práva a príklady obmedzení v úniových právnych predpisoch.
