Negotiating Enterpriser with Village

Abstract:

Téma „Jednání podnikatele s obcí“ lze považovat v dnešní době za velmi aktuální. V první části práce je popsán historický vývoj jednotlivých subjektů práva, které s tématem souvisí a jsou vysvětleny základní pojmy. Hlavní část práce je zaměřena na jednání podnikatele, který má zájem si od obce pronajmout a později odkoupit její majetek. Práce popisuje, jak jsou jednotlivé postupy upraveny právními předpisy. Zabývá se tím, jakým způsobem probíhalo skutečné jednání mezi podnikatelem a obcí v konkrétním případě a srovnává, zda všechny úkony proběhly podle zákonem stanovených pravidel a zda nedocházelo k jejich porušování či obcházení. Zároveň má práce sloužit jako podpůrný dokument, který může veřejnosti pomoci při jednání s orgány obce v obdobných případech. Zájemci – podnikatelé, kteří budou chtít s obcí uzavřít smlouvu týkající se nakládání s majetkem, budou vědět, s kterým odborem obecního úřadu či obecním orgánem mají konkrétní situaci řešit, co od kterého orgánu mohou požadovat a co mohou očekávat.

Abstract:

The topic of „Negotiating Enterpriser with Village“ can undoubtedly be regarded as very current. The first part of this work describes the historical development of various subjects of law that relate to the aforementioned topic. Furthermore, this section is dedicated to an explanation of basic concepts and terms. The main part of this work is focused on the steps taken by an enterpreneuer that is interested in rating and subsequently purchasing a municipality´s property. This thesis describes how these individual processes and steps are regulated by appurtenant legislation. Moreover, it looks at an actual communication that took place between an enterpreneuer and a local government in particular circumstances, and furthermore evaluates whether or not all steps were carried out in accordance with statutory. At the same time it is this work´s ambition to serve as a supporting document that can be of substantial help to the public user in their dealings with official bodies of village in similar cases. Enterpreneueres interested in entering into contract with an official bodies of village that pertain to disposal of property will be informed abou which department of a municipal office they should contact in a particular situation ass well as what they can demand or expect from a specific department.
