Abstract:

Diplomová práce se věnuje kolektivnímu vyjednávání a kolektivním sporům. Práce je členěna na šest částí, ve kterých se věnuje dílčím úsekům souvisejících s danou materií. Diplomová práce si klade za cíl analyzovat právní úpravu kolektivního vyjednávání a kolektivních sporů. V počátku je osvětlen historický vývoj, včetně nejpodstatnějších institutů, které jsou úzce spjaty s tímto tématem a dozajista se podílely na současné podobě stávávající právní úpravy. Jednou ze stěžejních částí je kolektivní vyjednávání, která líčí celý tento proces  v souladu se zákonem č. 2/1991 Sb., o kolektivním vyjednávání. Mimo jiné osvětluje například subjekty oprávněné kolektivně vyjednávat a kolektivní smlouvy. Druhá dominantní část práce se věnuje již samotným kolektivním sporům, kde objasňuje jejich dělení a postupný způsob řešení v souladu s dikcí zákona č. 2/1991 Sb., o kolektivním vyjednávání. Práce věnuje i pár slov právní úpravě kolektivního vyjednávání a kolektivních sporů na Slovenské republice. V neposlední řadě přináší i relevantní soudní judikaturu. V samém závěru práce autorka presentuje své úvahy de lege ferenda, ke kterým došla během analyzování právní úpravy.

Abstract:

The thesis focuses on collective bargaining and collective disputes. The thesis is divided into six parts, in which it focuses on sub-sections related to the material. The thesis aims to analyse the legal regulation of collective bargaining and collective disputes. In the beginning, the historical development is explained, including the most important institutes that are closely related to this topic and have certainly contributed to the current form of the existing legislation. One of the key parts is collective bargaining, which describes the whole process in accordance with Act No. 2/1991 Coll., on collective bargaining. Among other things, it explains, for example, the entities authorised to bargain collectively and collective agreements. The second dominant part of the thesis is devoted to the collective disputes themselves, where it explains their division and the gradual way of their resolution in accordance with the diction of Act No. 2/1991 Coll., on collective bargaining. The thesis also devotes a few words to the legal regulation of collective bargaining and collective disputes in the Slovak Republic. Last but not least, it presents relevant court case law. At the very end of the thesis the author presents her de lege ferenda considerations that occurred during the analysis of the legislation.
