EU and US trade disputes under the WTO

Abstract:

Tato práce se zabývá problematikou řešení sporů EU a USA v rámci Světové obchodní organizace. Cílem práce je vymezení problémů, se kterými se tento mechanismus potýká, a snaha o navržení možných řešení, které by přispěly k zefektivnění procesu řešení sporů. V první kapitole pojednává o jeho vývoji, který je nezbytný pro porozumění dané problematiky. Jedním z nejčastějších předmětů sporu je princip nediskriminace, který je však zároveň jeden ze stavebních kamenů dohod WTO. Práce věnuje pozornost formulaci příslušných ustanovení a pokouší se určit, zda je výčet generálních výjimek z tohoto principu dostačující. Za účelem dedukce závěrů, aplikuje metodu analýzy na vybrané spory.

Abstract:

This thesis is concerned with the matter of the EU/US dispute settlement under the World Trade Organisation. The goal is to introduce existing issues of this system and to propose possible solutions, that could be used to streamline the process. Understanding of the evolution of the system is essential to grip why was the mechanism designed as it was. This is described in the first chapter of the thesis. Common reason for disagreement is among others the non-discrimination principle, which is also the bedrock of WTO agreements. The work examines the wording of related provisions and attempts to establish whether the exceptions from this rule are sufficient. In order to obtain the final conclusions we analyze mentioned disputes in detail.
