Basic principles of civil law

Abstract:

Téma této diplomové práce je zaměřeno na obecné zásady občanského práva. Zásady právní obecně provází právo již od jeho samotného počátku a lepší poznání těchto principů usnadňuje i lepší orientaci v jiných právních odvětvích. Cíl této práce je vytvořit ucelený výčet obecných zásad občanského práva, včetně obecné teorie o jejich původu a doktrinálního, či soudního pohledu. Úvodní část této práce je zaměřena více na zásady právní obecně. V této části je nejvíce použito poznatků z učebnic občanského práva a dalších monografií různých autorů. Následující a hlavní část této práce je již věnována přímo na obecné zásady občanského práva. Zde je kromě výše vedených zdrojů navíc hojně využíváno online komentářů a judikatury. Dále jsou u jednotlivých zásad uvedeny praktické příklady podložené právní normou, či judikaturou. Celá tato práce je zaměřena na takové zásady, o kterých se jednotliví autoři shodují, že se jedná základní zásady občanského práva. Nicméně doktrinální pohled již není zcela jednotný v otázce, které z těchto zásad jsou primární a které jsou od těchto zásad odvozené. Struktura této práce naznačuje autorův názor na vzájemný vztah jednotlivých zásad. Důležité pro lepší znalost v oblasti obecných zásad občanského práva spočívá v poznání více názorů různých autorů. Na základě těchto znalostí je vhodné si vytvořit vlastní názor, ke kterému směru se přiklonit. S tímto je spojena otázka od kterých znalců čerpat informace. Jako vodítko je spatřována určitá názorová shoda původních autorů s názory autorů dnešních.

Abstract:

The topic of this diploma thesis is focused on the general principles of civil law. Principles of law in general have accompanied the law since its very beginning and a better understanding of these principles facilitates a better orientation in other branches of law. The aim of this thesis is to produce a comprehensive account of the general principles of civil law, including a general theory of their origin and a doctrinal or judicial perspective. The introductory part of this thesis focuses more on legal principles in general. In this part, most of the knowledge from civil law textbooks and other monographs by various authors is used. The following and main part of this thesis is already devoted directly to the general principles of civil law. Here, in addition to the sources listed above, there is extensive use of online commentaries and case law. Furthermore, practical examples supported by legal norms or case law are given for each principle. The focus of this entire work is on those principles which the various authors agree are fundamental principles of civil law. However, the doctrinal view is no longer entirely unanimous as to which of these principles are primary and which are derived from these principles. The structure of this paper indicates the author's view of the interrelationship of the principles. The important thing for a better understanding in the field of general principles of civil law lies in knowing more about the views of different authors. On the basis of this knowledge, it is useful to form one's own opinion as to which direction to take. Related to this is the question of which experts to draw information from. A certain degree of agreement between the views of the original authors and those of today's authors is seen as a guide.
