The claims of insureds from the all-risks insurance

Abstract:

Abstrakt V této bakalářské práci popisuji, které skutečné nároky na případnou výplatu pojistného plnění mají klienti vůči pojistiteli s kterým dobrovolně uzavřeli havarijní pojištění. Je zde uvedeno jakými zákony a všeobecnými pojistnými podmínkami se toto pojištění řídí. Popisuji zde vznik potřeby klienta uzavřít pojistnou smlouvu na havarijní pojištění od jejího založení přes detailní popis za jakých podmínek je možné pojistnou událost chápat jako oprávněnou a tedy obdržet pojistné plnění od pojistitele. Dále jsou zde uvedeny výluky z pojistného plnění a vysvětlena likvidace pojistných události na motorových vozidlech v oblasti teorie a následné praxe. V praktickém případě jsem se zaměřil na poukázání rozdílu ve výpočtu škody poškozeného vozidla. Je zde detailně rozebrán postup výpočtu parciální škody z havarijního pojištění při dodání faktury ze servisu a při rozpočtu nákladů na opravu čili opravou svépomocí. Je zde vyčíslen rozdíl v plnění pro klienta a jeho detailní rozbor. V této práci je i nastíněno řešení úplných tzv. totálních škod. V závěru práce poukazuji na potřebu uzavřít havarijní pojištění kvůli eliminaci rizika na majetku klienta. Vyzdvihuji zde důležitost rozhodnutí klienta při volbě pojistitele z hlediska ceny produktů a výše pojistného plnění.

Abstract:

Abstract In this Bachelors thesis I describe the real claims for contingent compensation that the clients have got against Insurer which they voluntarily underwrote the all-risks insurance with. The laws and general policy conditions of this insurance are mentioned here. Here I describe the origination of client‘s need of underwritting the all-risks policy from its start-up over the detailed description of conditions which it is possible to comprehend the claim to be authorized on and receive the compansation from the Insurer. There are further mentioned the indemnity exclusions and there is also explained the settlement of motor-vehicles claims in district of theory and subsequent praxis. In practical case I put my mind on pointing out a difference in calculation of damaged vehicle costs. In detail there is processed the procedure of partial costs calculation from the all-risks insurance when the repair invoice from repair garage is given and when there is made a costs estimate alias repairation by self-help. The difference in settlement for client and his detailed analysis are calculated here. In this thesis there is also outlined the solving the complete loss so called total loss. At the close of this thesis I advert to client’s need of all-risks insurance signing-up because of elimination of the risks of clients property. I advert to the importance of client‘s decision while he is choosing the Insurer in light of product price and height of indemnity.
