Alcohol and Drugs at vehicle control-An issue of hearing of offences

Abstract:

Mnou předložená bakalářská práce se zabývá vlivem alkoholu a drog, resp. nealkoholových návykových látek, na bezpečnost a plynulost provozu na pozemních komunikacích. Podstata práce vychází z faktu, že problematika alkoholu a drog za volantem se stále více dostává do popředí zájmu společnosti o řešení tohoto velmi negativního zdravotně-společenského jevu. Práce je metodicky rozdělena na dvě části, teoretickou a praktickou. V teoretické části, v prvních dvou kapitolách, je pozornost věnována všeobecným poznatkům o alkoholu a drogách, opírající se především o poznatky odborné veřejnosti. V praktické části, v kapitole zaměřené na řízení o přestupcích, je co nejpodrobněji popsána a vyhodnocena problematika projednávání přestupků proti bezpečnosti a plynulosti provozu na pozemních komunikacích, páchaných v souvislosti s požíváním alkoholu, nebo užíváním jiných návykových látek. V samotném závěru jsou popsány návrhy možných opatření v oblasti represe i prevence, včetně popisu přijetí některých nutných změn v právní úpravě provozu na pozemních komunikacích.

Abstract:

The bachelor’s thesis I present herewith addresses the influence of alcohol, drugs and non-alcoholic addictive substances on the safety and fluency of road traffic. The essence of the work proceeds from the fact that the problem of alcohol and drugs behind the steering wheel is moving to the forefront of the community’s interest in dealing with this extremely negative health and social phenomenon. The work is methodically divided into two parts: the theoretical and the practical. In the theoretical part, in the first two chapters, attention is given to the general knowledge on alcohol and drugs, which is primarily based on experts’ finding. In the practical part, in the chapter focused on traffic offence proceedings, the issue of dealing with offences against road traffic safety and fluency committed in relation to the consumption of alcohol or other addictive substances is described and analysed in great detail. The conclusion describes proposals for possible measures in the area of repression as well as prevention, including a description of adoption of some necessary amendments to road traffic regulations.
