Enforcement of judicial and other decisions

Abstract:

The aim of this bachelor work is to explain the problem and to provide information about compulsory enforcement of judicial and other decisions as well as to describe the difference between the beginning of execution and the enforcement of execution according to Execution Act and the enforcement of a judicial decision according to Civil Procedure Act. In the work we would like to show simplified description of all ways of executions, particular phases of execution proceeding and members of proceeding. We also want to provide the review of beginnings of execution, historical development of execution law and development of execution law in our country as well as the ways of avoiding execution and how to confront it. In the following part we concentrate on the execution activities in tax system of the Slovak Republic and we would like to evaluate the contribution of tax executions into state budget revenue.

Abstract:

Cieľom tejto bakalárskej práce je priblížiť problematiku a poskytnúť informácie o nútenom výkone súdnych a iných rozhodnutí, popísať rozdiel medzi začiatkom exekúcie a vykonaním exekúcie podľa Exekučného poriadku a výkonom rozhodnutia podľa Občianskeho súdneho poriadku. V práci chceme uviesť zjednodušený popis všetkých spôsobov exekúcii, jednotlivé fázy exekučného konania a účastníkov konania. Tiež chceme spomenúť pohľad na začiatky exekúcie, historický vývin exekučného práva a vývoj exekučného práva na našom území a ako sa exekúcii vyvarovať alebo ako jej čeliť. V ďalšej časti budeme pracovať s exekútorskou činnosťou v daňovej správe Slovenskej republiky a pokúsime sa zhodnotiť prínos daňových exekúcii do príjmov štátneho rozpočtu.
