Abstract:

Tato práce pojednává o vymezení vztahu mezi obecnými soudy, jako složkami státní moci, tedy veřejnoprávními institucemi a rozhodci, jako osobami soukromého práva, nadanými pravomocí autoritativně rozhodovat určité spory fyzických a právnických osob. Tento vztah je zkoumán ze třech základních pohledů, odvíjejících se od stádia rozhodčího řízení. Míra ingerence soudní moci do rozhodčího řízení je tak analyzována samostatně v otázkách zahájení rozhodčího řízení, jeho vedení a po jeho skončení. Z povahy věci má role soudu v prvých dvou případech funkci pomocnou, kdy napomáhá rozhodcům řádně projednat a rozhodnout daný spor, zejména náležitě zjistit skutkový stav věci, ve třetím případě, tedy po vydání rozhodčího nálezu se naopak tato role mění na funkci kontrolní, kdy soud zkoumá, zda byly ze strany rozhodců dodrženy základní zásady spravedlivého procesu. Cílem této práce je tak komplexně zhodnotit jednotlivá práva a povinnosti ze strany rozhodců k obecným soudům a naopak a zasadit takto zjištěné teoretické poznatky i do praktické roviny.

Abstract:

This thesis discusses the relationship between courts as parts of state power and arbitrators as subjects of private law, who are entitled to resolve disputes between natural and juristic persons. This relationship is observed from three main points of view, each depending on a certain phase of arbitration. The rate of interference by the judicial power in arbitration is analyzed independently, starting with the beginning of arbitration, its proceeding and after its end. In the first two cases, the role of the courts is an auxiliary function as the courts are supposed to help the arbitrators discuss and decide the outcome of the case properly, especially in investigating the facts of a particular case without any reasonable doubts. In the third case, the role of the courts changes more to control function as the they examine if all basic obligations arising from the right for fair trial were followed by the arbitrators. The aim of this thesis is to judge all mutual rights and duties of courts and arbitrators comprehensively and to try to apply this theoretic knowledge in a practical way.
