Abstract:

Tématem diplomové práce je Institut trvalého pobytu v České republice, kterému se věnuje z mnoha různých úhlů pohledu. Adresa místa trvalého pobytu představuje pro českého člověka základní identifikační údaj, na který je navázán vysoký počet dalších právních předpisů a s tím souvisejících běžných životních situací občanů České republiky. Místo trvalého pobytu je však především evidenčním údajem a často neodpovídá místu, kde lidé skutečně trvale pobývají a kde žijí, což jim může následně působit určité obtíže. Cílem práce je poskytnout čtenáři ucelený pohled na uvedenou problematiku včetně stručného zasazení do historického kontextu, dále porovnat veřejnoprávní pojem trvalého pobytu se soukromoprávním pojmem bydliště, vysvětlit změnu, ukončení a zrušení údaje o místu trvalého pobytu, a zejména čtenáře seznámit s některými souvislostmi, problémy a obtížemi, které z návaznosti na místo trvalého pobytu plynou. Spíše pro zajímavost a inspiraci práce stručně představuje i pozici a funkci rezidenční adresy ve Velké Británii a Spojených státech amerických.

Abstract:

The topic of this Theses is „The Institute of Permanent Residence in the Czech Republic“, which is defined from various points of view. The permanent residence address represents a basic identification data for a Czech person and it is connected to a high number of legal regulations, and to many ordinary every-day-life situations of the Czech Republic citizens at the same time. However, the actual place of permanent residence does not often reflect the place where people truly reside and live permanently, which may cause some difficulties consequently. The aim of the theses is to give the reader an overall view of the issue, including setting it into a historical context, to compare the public law concept of permanent residence with the private law concept of residence, and to explain the process of the permanent residence change, termination and cancellation. In particular, the aim is to get the reader acquainted with some of the consequences, issues and difficulties which result from the function of the permanent residence. For interest and inspiration, the position and the role of residential address in the Great Britain and in the United states of America is briefly introduced.
