Criminal Law and Procedural Aspects of the Role of a Witness in the Criminal Proceedings
Abstract:
Podstatou diplomové práce je vymezení pozice svědka v trestním řízení. První část obsahuje rozbor osoby svědka a svědečné subjektivity. Následuje shrnutí práv a povinností svědka, včetně následků porušení povinností a možnosti ochrany. Vše uzavírá několik poznámek k právnímu styku s cizinou v souvislosti s podáním svědecké výpovědi.
Abstract:
This thesis deals with the role of a witness in criminal proceedings. First part includes an analysis of the personality of the witness and of the capacity to be a witness. It is followed by an overview of the rights and obligations of a witness, including the consequences of breaching these obligations and the posibility of protection.
