Abstract:

Tato bakalářská práce se věnuje problematice ochraně spotřebitele v českých právních podmínkách, mimosoudnímu řešení sporů v naší legislativě i zemích Evropské unie a následné nutnosti vytvoření smírčího orgánu, který chrání spotřebitele bankovních a finančních služeb, tedy Kanceláře finančního arbitra. Dále se práce zabývá podrobným rozborem činností finanční arbitra i činnostmi jeho zástupce (řešení sporů mezi poskytovateli a uživateli platebních služeb, vydavateli a držiteli elektronických peněz), a aktuálním rozšířením pravomocí, které rozhodují spory mezi věřiteli nebo zprostředkovateli a spotřebiteli (při nabízení, poskytování nebo zprostředkování spotřebitelského úvěru). V oblasti kolektivního investování se pravomoc finančního arbitra rozšířila na rozhodování sporů mezi investiční společností nebo fondem a na druhé straně investorem, tedy spotřebitelem. Cílem této práce je představit Kancelář finančního arbitra jako moderní, dynamický a rozvíjející se orgán mimosoudního řešení sporů, objasnit jeho význam jak pro společnost, tak pro samotné spotřebitele, tedy klienty bank a dalších finančních institucí působících v České republice, které v těchto sporech vystupují jako protistrany. Za cíl si také dává nástin možného rozšíření kompetencí a pojednání o výhledovém působení Kanceláře finančního arbitra do budoucna.

Abstract:

This bachelor thesis deals with consumer protection under Czech laws, out-of-court dispute settlement in the Czech legislation and in European Union member states, and the necessity to create a conciliation authority that would protect consumers of banking and financial services, i.e. a Financial Arbitrator’s Office. This thesis analyses the activities of the financial arbitrator’s office and its representative (resolution of disputes between the users and the providers of payment services, or the issuers and the holders of electronic money), and also the current extension of the powers of those who settle disputes between the creditors or the mediators, and the consumers (in the offering, providing and mediating of consumer credits). In the field collective investment, the powers of financial arbitrators expanded to disputes between investment companies or funds on the one part, and the investor, i.e. the consumer, on the other part. The aim of this thesis is to present the Office of the Financial Arbitrator as a modern, dynamic and growing body for out-of-court dispute resolution, to explain its importance for the society and for the consumers – clients of banks and other financial institutions operating in the Czech Republic, who constitute the counterparties in this kind of disputes. In addition, this thesis aims at outlining the possible expansion of the powers and future functioning of the Office of the Financial Arbitrator.
