Schengen Space in EU

Abstract:

Ve své diplomové práci se zabývám schengenským prostorem v rámci EU. Ten představuje obecně rozšířený pojem, jenž zpravidla asociuje možnost volného překračování hranic mezi státy Schengenu. Otevření hraničních přechodů skutečně představovalo hlavní myšlenku celé schengenské otázky. Uskutečnění tohoto cíle však trvalo řadu let, neboť se během jeho realizace vyskytla celá řada obtíží. Zrušení kontrol na společných hranicích umožnilo maximální volnost pohybu osob při jejich překračování. Současně však došlo k ohrožení vnitřní bezpečnosti. Odstranění kontrol na hraničních přechodech se tak stává jednou nikoliv jedinou otázkou v schengenském systému. Státy postupně spolupracují v oblasti svobody, bezpečnosti a práva. Hledá se společné řešení v azylové a vízové politice a dalších oblastech. Přesto, že Schengenské dohody byly původně uzavřeny jako mezinárodní smlouvy, rozsahem své působnosti a také úsilím členských zemí se postupně stávají součástí komunitárního práva EU.

Abstract:

I am devoting my dissertation to the subject of Schengener Region within the framework of the EU. It has to do with the commonly widespread expression which is usually associated with the provided possibility of unrestricted border crossing between the Schengen-States. The opening of the border crossings constituted the essential keynotes of the Schengen issue. However, the materialization of this objective took a series of years because during it is conceptualization, a complete range of difficulties emerged. The lifting of checkpoints at the shared borders made possible a maximum freedom of moment at their crossing points. At the same time, homeland security became endlandered. The elimination of checkpoints at the border crossings become one concern, however not the only question within the Schengen System. The states are working together in the areas of freedom, safety and rights. They look of common solutions concerning refuge and visa policy, as well as other areas. Even though the Schengener Agreements were originally negotiated on the international level, they came into being due to the magnitude of their impact and also thanks to the efforts of the member states for their contributions to EU Community Law.
