Comparision of Systems of the Probation and Mediation Service in the CR and states of EU

Abstract:

Tato diplomová práce se zabývá komparací systémů Probační a mediační služby ČR a jiných zemí EU. Toto téma jsem si zvolila z toho důvodu, že se s činností probační služby a celé problematiky alternativních trestů setkávám jako úředník PMS ČR každý den. Úkolem probační služby je především zprostředkování řešení trestních sporů a také dohled a kontrola nad výkonem alternativních trestů. Cílem probační služby ČR je integrace pachatele zpět do společnosti, participace poškozeného do procesu vlastního odškodnění a v neposlední řadě také ochrana společnosti řešením trestních konfliktů. Práce zahrnuje přehled o činnosti a systému PMS ČR, o alternativních trestech, o systémech probačních služeb ve státech EU. Tyto probační systémy dále srovnává a zhodnocuje, zjišťuje rozdíly a vzájemné shody v činnosti probačních služeb i celých právních řádů srovnávaných zemí.

Abstract:

This thesis deals with comparison of systems of Probation and Mediation Service in the CR and other EU countries. The theme I chose for that reason that the activities of probation services and the whole issue of alternative sanctions as an official this institution encounter every day. The task of the probation service, especially criminal dispute resolution mediation and supervision and control over the performance of alternative sanctions. Aspiratoin of probation services is the integration of offenders back into society, participation in the process damaged his own compensation and, ultimately, the protection of solving criminal conflicts. Thesis includes an overview of the activities and systems of the PMS CR, alternative sentencing and the probation service systems in the EU. These probation systems also compares and evaluates, investigates differences and consensus on the activities of probation services and the entire legal systems compared countries.
