Abstract:

Disertační práce se zabývá problematikou nákladů exekuce. Podle exekučního řádu platí, že soudní exekutor vykonává exekuční a další činnost za úplatu. Příjmy soudního exekutora z exekuční a další činnosti jsou regulovány exekučním tarifem. Současně platí výrazné zákonné omezení, že činnost exekutora je neslučitelná s jinou výdělečnou činností s výjimkou správy vlastního majetku. Z hlediska obsahu je v práci nejprve vymezeno postavení soudního exekutora z hlediska justice, ale i jako podnikatele. Uceleným způsobem je zmapován vývoj exekučního tarifu. Předložena je současně právní analýza platné právní úpravy nákladů exekuce. Z hlediska komparace je zvoleno Slovensko a Francie. Stěžejní část práce představují kapitoly, ve kterých je provedena analýza tzv. spotřebního koše exekutorského úřadu včetně ekonomických ukazatelů, které ovlivňují nákladovost. Dále pak analýza nákladovosti exekučního spisu. Především jsou pak podle výsledků provedených analýz navrženy varianty legislativního návrhu exekučního tarifu, ale i dalších institutů, které mají přispět k celkové modernizaci exekučního řízení, zvýšení vymahatelnosti práva, ale i hospodárnosti celého řízení. Dále povedou k zajištění udržitelnosti exekuční činnosti prováděné soudními exekutory.

Abstract:

The dissertation deals with the issue of costs of execution. According to the Execution Code, an executor performs execution and other activities for a fee. The income of the bailiff from execution and other activities is regulated by the execution tariff. At the same time, there is a significant statutory restriction that the activity of the bailiff is incompatible with any other gainful activity, except for the management of one's own property. In terms of content, the thesis first defines the position of the bailiff from the point of view of the judiciary, but also as an entrepreneur. The development of the execution tariff is mapped out in a comprehensive manner. At the same time, a legal analysis of the current legal regulation of execution costs is presented. Slovakia and France are chosen for comparison. The main part of the thesis is represented by chapters in which an analysis of the so-called consumer basket of the bailiff's office is made, including economic indicators that influence the cost. This is followed by an analysis of the costliness of the enforcement file. Above all, according to the results of the analyses, variants of the legislative proposal of the execution tariff are proposed, as well as other institutes that should contribute to the overall modernization of the execution procedure, increase the enforceability of the law, but also the economy of the whole procedure. Furthermore, they will lead to ensuring the sustainability of the enforcement activity carried out by bailiffs.
