The Czech Trade Inspection Authority and the goods infringe the owner´s intellectual property rights

Abstract:

Cílem této diplomové práce je přiblížit činnost České obchodní inspekce (ČOI) se zaměřením na zboží porušující některá práva majitele duševního vlastnictví. V první kapitole teoretické části je rozebráno postavení a právní úprava ČOI. Následuje popis práv a povinností pracovníků ČOI, ukládaná opatření, a také formy ukládání sankcí za porušení povinností, stanovených v zákonech dozorovaných ČOI. Další kapitola je věnována spolupráci ČOI s dalšími orgány, a to spolupráci jak na poli vnitrostátním, tak i mezinárodním. V závěru teoretické části je charakterizováno duševní vlastnictví a právo, které k němu vzniká. Praktická část je plně věnována porušování práv majitelů duševního vlastnictví. Zejména je kladen důraz na zboží porušující některá práva majitelů duševního vlastnictví dozorované ČOI, postup při vyhledávání, zajišťování a nakládání s takovým zbožím. V rámci praktické části je proveden rozbor činnosti k dané problematice na celorepublikové a krajské úrovni a také metody předcházení uvedení zboží na republikový trh.

Abstract:

The target of this thesis is to introduce the activity of the Czech Trade Inspection Authority (CTI) with a focus on the goods infringing some owner´s intellectual property rights. The role and legal regulation of the CTI are discussed in the theoretical part of the first chapter. The description of the rights and obligations of the CTI employees, put measures and also forming the penalties for infringing the obligations specified in the law supervised by the CTI, are listed below. The next chapter is devoted to the CTI cooperation with other authorities on the national as well as international field. The intellectual property and right, which arises to it, are characterized in the closure of the theoretical part. The practical part is fully devoted to infringing owner´s intellectual property rights. The goods infringing some owner´s intellectual property rights, supervised by the CTI, the search process, securing and disposal of such goods are especially emphasized. The activity analysis of such problem on the nationwide and regional level and also prevent methods of placing the goods on the republican market are done in the scope of the practical part.
