Comparison of labour law status of officials and other employees of the regions

Abstract:

Cílem diplomové práce je analýza, rozbor a zhodnocení právní úpravy postavení úředníků a ostatních zaměstnanců územních samosprávných celků. V první kapitole je autorova pozornost věnována základním pojmům jako veřejná správa a její členění na státní správu a samosprávu. Dále na úředníka, vedoucího úředníka a vedoucího úřadu. V následující druhé kapitole se zaměřuje na přehled hlavních právních předpisů, charakteristiku profese úředníka a také na odlišnosti při vzniku, trvání, jmenování a zániku pracovního poměru úředníka. Ve třetí kapitole se věnuje charakteristice ostatních zaměstnanců, vznik, trvání a zánik pracovního poměru ostatního zaměstnance. Součástí této kapitoly je také porovnání právní úpravy postavení úředníků a ostatních zaměstnanců územních samosprávných celků. V samotné závěrečné kapitole se věnuje postavení úředníků a ostatních zaměstnanců krajů, vyhodnocení výzkumu a pracovní pozice, srovnání povinností a přínosy a negativa jejich současného postavení. V závěru se diplomové práce věnuje případnému návrhu doporučení ke změnám.

Abstract:

The aim of the thesis is to analyze, analyze and evaluate the legal regulation of the status of officials and other employees of local self-government units. In the first chapter, the author's attention is paid to basic concepts such as public administration and its division into state administration and local government. The chapter also includes the distinction between a civil servant, a senior civil servant and the head of an authority. In the following second chapter, he focuses on an overview of the main legal provisions, the characteristics of the profession of a civil servant, as well as the differences in the creation, duration, appointment and termination of the civil servant's employment. The third chapter looks at the characteristics of other servants and the creation, duration and termination of the employment of other servants. This chapter also includes a comparison of the legal regulation of the status of officials and other employees of local self-government units. The very final chapter discusses the status of county officials and other employees, an evaluation of the research and job position, a comparison of duties, and the benefits and negatives of their current status. Finally, the thesis concludes with possible recommendations for change.
