Consumer protection and information obligation of entrepreneurs

Abstract:

Cílem této diplomové práce je zprostředkovat ucelené základní informace v oblasti ochrany spotřebitele, a to jak z pohledu spotřebitele, tak i z pohledu podnikatele. Současně je třeba specifikovat povinnosti obchodníka, zvláště pak s důrazem na jeho informační povinnosti. Vzhledem k rozsáhlosti problematiky spotřebitelského práva, se tato diplomová práce soustředí zejména na informační povinnost podnikatelů. Cílem práce je podat analýzu informační povinnosti v souvislosti s ochranou spotřebitele. Výsledkem analýzy má být odpověď na otázku, zda je ochrana spotřebitele a informační povinnost podnikatelů v české legislativě zakotvena dostatečným způsobem, a zdali není v rozporu s evropským právem.

Abstract:

The purpose of this thesis is to provide basic and comprehensive information concernig the field of consumer protection, both from the perspectives of the consumer and the entrepreneur. Concurrently, i tis necessary to specify the obligations of merchants, especially regarding the concept of information duty. Due to the extent of these issues surrounding consumer law, this thesis will analyze the information obligation of entrepreneurs. The overall aim of this analysis is to answer the question of whether consumer protection and information obligation of entrepreneurs in Czech legislation is sufficiently grounded and if it is consistent to European law.
