Payment System in the Czech Republic

Abstract:

Tato práce je zaměřena na popis nové přávní úpravy v rámci cele Evropské unie a s jejími dopady na legislativu České republiky. Je zde uvedena podrobná charakteristika hlavních právních norem, a to je jak Směrnice o platebních službách na vnitřním trhu, tak nového platebního zákona č. 284/2009 Sb.. Z hlediska charakteristiky Směrnice o platebních jsem popsala obsah jednotlivých hlav této směrnice a jejich článků. Dále se věnuji procesu implementace Směrnice o platebních službách do českého práva, který začal veřejnou diskusí, kterou iniciovalo Ministerstvo finančí ČR. Jednotlivé body diskuse jsou zde vyjmenovány a detailně popsány. Dále jsem podrobně rozebrala rozsáhlou legislativy upravující oblast platebního styku v České republice. Jde o nejvýznamnější legislativní rámec upravující tuto oblast v ČR, také proto se mu v rámci druhé kapitoly věnuji detailně. V další kapitole popisuji projekt Single Euro Payment Area (SEPA), který patří ke stěžejním projektům v oblasti platebního styku. V kapitole SEPA jsou uvedeny jednotlivé platební nástroje, mezi které patří SEPA pro bezhotovostní úhrady, SEPA inkasa, SEPA pro platební karty a SEPA hotovost. Z hlediska výše popsaného jsem se dále věnovala dopadům jednotlivých změn na bankovní sektor a na samotné klienty, a to i s ohledem na základní legislativní remce a následovně implementované procesy v závislosti na těchto zákonech a Směrnicích. V úvodu těchto kapitol jsou popsány obecné charakteristiky a následovně je provedena analýza konkrétních dopadů výkladu nového zákona o platebním styku u českých bank pro klienty.

Abstract:

My work is focused on a description of the law legislation throughout all European Union and its impacts on the legislation in the Czech republic. There is indicated a detailed characteristic of the main legal standarts as Payment Services Directive and new czech law 284/2009 Sb. covering the payment services. In terms of charasteristic of PSD I described the contents of its individual titles and also the individual articles. Further I wrote about the process of the implemenation of Payment Services Directive into the czech law, which begun by public disscusion, which was accounced by Minister of finance Czech republic. Each points of disscusion are listed and described in detail. I analysed an extensive legislative issues regulating the payment services in the Czech republic. It is the most important legislation regulating this field in the Czech republic. and that´s why I talk about it in detail in chapter two. In the follewed chapter I described the project Single Euro Payment Area, which belongs to the key projects of European Union in the filed the payment system. In this chapter there are indicated the individual payment instruments including SEPA credit transfer, SEPA debit transfer, SEPA for payment cards and SEPA for cash. As all mentioned above I wrote about the impacts of individual changes in the czech banking and on their clients themselves with regard to basic legislation and then the processes of implementaion depending on the new law and the Directive. At the beginning of this chapter I describe the general characteristic and then I analysed the specific impacts of intepretation of law in the czech banks for their clients.
