Current Issues of Governance in the Field of Heritage Preservation

Abstract:

Tato diplomová práce na téma Aktuální otázky správy na úseku památkové péče pojednává o právní úpravě na tomto úseku, tj. o stále platném zákonu č. 20/1987 Sb., o státní památkové péči, který je srovnáván s nově navrhovanou právní úpravou. Nejdříve práce přináší obecnou komparaci zákonů a následně i konkrétnější prostřednictvím nejvíce kritizovaných bodů stávajícího zákona. Zhodnocení aktuální právní úpravy je doplněno o komparaci se zahraniční právní úpravou památkové péče v Rakousku. V závěru jsou uvedeny doporučení de lege ferenda.

Abstract:

This diploma thesis dealing with the topic Current Issues of Governance in the Field of Heritage Preservation is concerned with the cultural heritage legislation, namely Act No. 20/1987 Coll., on State monument care, which is still in force. This law is compared with the new heritage bill, which is about to be passed. Firstly, the thesis provides general comparison of both laws and then even specific one via the most criticised topics of the current law. The appraisal of the current legislation is followed by a comparison with the cultural heritage legislation in Austria. Finally, there are mentioned some recommendations de lege ferenda.
