The Person of Arbitrator in Arbitration Proceedings

Abstract:

Rozhodčí řízení prošlo v posledních dvaceti letech obrovskou proměnou. Z okrajového způsobu řešení sporu se stalo hojně frekventovaným způsobem řešení majetkových sporů, které se těší oblibě především podnikatelské sféře. Vedle rychlosti a menší nákladnosti je toto řízení oblíbené u mnoha subjektů též z důvodu možnosti výběru rozhodce. Právě od kvality rozhodce se zásadně odvíjí kvalita rozhodčího řízení. V rigorózní práci bylo podrobně zanalyzováno celé řízení z pohledu jeho osoby a zdůrazněny byly základní nároky, které jsou na osobu rozhodce kladeny. Zatímco osobní předpoklady splní velké množství subjektů, podceňována je zejména fáze samotného průběhu rozhodčího řízení. Zvýrazněny byly především základní nároky a povinnosti, které rozhodce musí dodržet. Významnou roli v celé rigorózní práci hrála komparace se zahraniční právní úpravou. Novelou zákona o rozhodčím řízení došlo k výraznému odlišení sporů ze spotřebitelských smluv a sporů ostatních. Nedošlo však k reflexi zvýšené judicializace rozhodčího řízení. Zákon o rozhodčím řízení byl v závěru podroben poměrně výrazné kritice. V souvislosti s osobou rozhodce byly zmíněny i mimoprávní oblasti jako etické či morální kvality. Nedílnou součástí rigorózní práce byly též návrhy de lege ferenda.

Abstract:

The arbitration has undergone a tremendous change in the last twenty years. From a marginal form of dispute settlement it has become one of the most frequently used ways of solving property disputes, which became popular mainly in the business sphere. Besides the speed and cost, the arbitration is preferred mainly for the right of choice of the arbitrator. It is the quality of the arbitrator, which can be seen as a pillar of the quality of the whole arbitration proceeding. This thesis has analysed in detail the whole arbitration procedure from the perspective of the arbitrator and emphasized the basic demands that are placed on the person of the arbitrator. While personal assumptions can be meet by a large number of subjects, the role of the personality is underestimated at the stage of the arbitration itself. This thesis highlighted mainly basic demands and responsibilities that an arbitrator must follow. Important part of the thesis consists also of the comparison with foreign legislation. The amendment of the Arbitration Act created a significant differentiation from consumer contracts disputes and others disputes. However, the amendment did not bring a reflection of increased judicialization of the arbitration. Therefore, in the final part, the Arbitration Act was subject of a relatively strong criticism. In connection with a person of the arbitrator the ethical or moral qualities were also mentioned as areas outside the law. An integral part of the thesis is represented by the suggestions de lege ferenda.
