Abstract:

Tato diplomová práce se zabývá problematikou odpovědnosti státu za činnost soudního exekutora, která v posledních pěti letech nabývá na významu, a to zejména s ohledem na posilování pravomocí soudních exekutorů, jejichž postavení z hlediska jejich pravomocí se začíná legislativními změnami posouvat do roviny orgánů moci soudní bez přiměřených záruk zajišťujících jejich nestranné a nezávislé rozhodování při nuceném výkonu pravomocných rozhodnutí a jejichž činnost zásadním způsobem zasahuje do základních práv a svobod účastníků exekučního řízení. Snaží se podrobněji analyzovat současnou právní úpravu odpovědnosti státu za činnost soudního exekutora v návaznosti na aktuální judikaturu a poukázat na mezery v této úpravě. V závěru příslušných kapitol této práce jsou předestřeny možné legislativní změny k optimalizaci současné právní úpravy směřující ke zvýšení standardu ochrany osob dotčených činností soudních exekutorů prováděnou v rozporu se zákonem.

Abstract:

This diploma thesis deals with the liability of the State for the activity of the bailiff, which in the past five years is gaining importance, especially with regard to the strengthening of the powers of bailiffs, whose status in terms of their powers is starting to move into the plane of the legislative organs of the judicial power without adequate safeguards for their impartial and independent decision-making in compulsory enforcement of final decisions and whose activities significantly interferes with the fundamental rights and freedoms of the enforcement proceedings. Try to analyse in more detail the current legislation, the liability of the State for the activity of the bailiff in the wake of the current case law and point out the gaps in this adaptation. At the end of the relevant chapter of this work are possible legislative changes to optimize the current legislation with a view to raising the standard of protection of the persons concerned by the activities of bailiffs carried out in violation of the law.
