The European Regulation of State Aid in the Times of Economic Crisis

Abstract:

Problematika státních podpor tvoří jednu z klíčových oblastí evropského práva hospodářské soutěže. S příchodem svétové finanční a hospodářské krize se stala otázka poskytování podpor velmi aktuálním tématem. Ekonomiky většiny členských států Evropské unie byly následky krize krutě zasaženy a situace si žádala rychlé řešení. Jednotlivé státy začaly vymýšlet záchranné plány na podporu finančního sektoru a ostatních hospodářských odvětví. Evropská komise musela na vzniklou situaci okamžitě reagovat, jelikož existující pravidla pro poskytování státní podpory nebyla vzhledem k okolnostem zcela vyhovující. Během krátké doby proto formulovala přechodná pravidla, která napomohla jistému uvolnění podmínek pro poskytování podpor a větší pružnosti v procesu schvalování. Cílem této práce je v prvé řadě poskytnout ucelený přehled evropské právní úpravy státních podpor, jak z hlediska hmotněprávního, tak po stránce procesněprávní a v návaznosti na něj pak poukázat, v jaké míře ekonomická krize oblast státních podpor ovlivnila a jaké uplatnění přijatá přechodná pravidla nalezla v praxi.

Abstract:

The issue of state aids comprises one of the crucial parts of the European Competition Law. Due to the onset of the world financial and economic crisis, the matter of providing the aids happenned to be a topic of immediate interest. Economic systems of most European Union member states were unsparingly affected by consequences of the crisis and the situation required a genuinely rapid solution. States started individually contriving specific support schemes to encourage a financial sector and other branches of economy. The European Commission was urged to respond to this newborn plight instantly since present rules respective to providing the state aid was not unreservedly convenient, considering the peculiar circumstances. Within a brief period of time, the Commission formulated particular temporary rules which contributed to a certain loosening of conditions for providing of the aids and to a greater flexibility in the approval procedure. The aim of this diploma thesis is primarilly to offer a comprehensive compendium of European regulation of state aids, both from the substantial law perspective and with respect to the procedural law aspect, and in connection with this compendium, to demonstrate consequently to what degree the economic crisis have affected the sphere of state aids and what employ have the accepted temporary rules acquired in practise.
