The social status of offenders in court records in the 16th and 17th centuries

Abstract:

Bakalářská práce se zabývá analýzou raně novověkého hrdelního soudnictví a kriminality z perspektivy sociálních dějin, a to prostřednictvím studia deseti vybraných edic smolných knih z českého a moravského prostředí. Hlavním cílem je prozkoumat korelaci mezi sociálním postavením pachatelů a typem jimi páchaných deliktů. Pomocí kvantitativní, komparativní a mikrohistorické metody práce analyzuje specifika kriminálního jednání ve třech odlišných prostředích: vesnickém, městském a mobilním. Výzkum prokazuje, že zatímco na venkově byla majetková trestná činnost často motivována existenční nouzí marginalizovaných skupin, v městském prostředí představovala spíše snahu o vylepšení socio-ekonomické situace. Zcela specifickou hrozbu pak představovaly mobilní vrstvy, u nichž absence sociální koheze a ztráta cti vedly k páchání nejzávažnějších loupežných deliktů. Práce se rovněž věnuje genderové dimenzi kriminality a dokládá, že znevýhodněné postavení a strach ze sociální exkluze nutily ženy k typickým deliktům, jakými byly infanticidium či čarodějnictví. Závěry potvrzují, že čest jako mechanismus sociální kontroly fungovala v raném novověku často efektivněji než samotná hrozba hrdelních trestů

Abstract:

This bachelor thesis focuses on the analysis of early modern capital justice and criminality from the perspective of social history, through the study of ten selected editions of black books (executioner's records) from the Bohemian and Moravian environments. The main objective is to explore the correlation between the social status of offenders and the types of crimes they committed. Utilizing quantitative, comparative, and microhistorical methods, the thesis analyzes the specificities of criminal behavior in three distinct environments: rural, urban, and mobile. The research demonstrates that while property crime in rural areas was often motivated by the existential distress of marginalized groups, in the urban environment it generally represented an effort to improve one's socio-economic situation. A highly specific threat was posed by the mobile strata of society, whose lack of social cohesion and loss of honor led to the commission of the most serious robbery offenses. The thesis also addresses the gender dimension of criminality, illustrating that a disadvantaged position and the fear of social exclusion forced women into typical crimes such as infanticide or witchcraft. The conclusions confirm that honor, as a mechanism of social control, often functioned more effectively in the early modern period than the threat of capital punishment itself
