Legal capacity and guardianship for people with mild mental disabilities

Abstract:

Diplomová práce se zaměřuje na problematiku současného opatrovnictví a svéprávnosti u lidí s mentálním postižením žijících v chráněném bydlení. Toto téma je v současnosti velmi aktuální, neboť s příchodem nové legislativy, a to konkrétně nového Občanského zákoníku, došlo k podstatným změnám měnící institut svéprávnosti, který má dopad na samotné uživatele sociálních služeb. Empirická část je věnována uživatelům sociální služby chráněného bydlení, pomocí kterých se snažím najít odpověď na výzkumnou otázku, která se zabývá tím, zda a jaký vliv má navrácení svéprávnosti vliv na kvalitu života uživatelů v sociálních službách. Tento výzkum poukázal na spojitost mezi svéprávností, kvalitou bydlení a transformací v sociálních službách, které vzájemně mezi sebou tvoří důležitý celek pro kvalitu života uživatelů v sociálních službách. Výsledky této diplomové práce poslouží ke zkvalitnění konkrétní sociální služby a poskytnou zpětnou vazbu opatrovníkovi i managementu organizace.

Abstract:

The thesis is focused on the contemporary issues of guardianship and the legal capacity of the people with the intellectual disabilities who are living in sheltered housing. This subject matter is currently very actual, because with an introduction of the new legislation, namely the new Civil Code, there are substantial changes in the institution of the legal capacity, which has the impact on the users of the social services. The empirical part is devoted to the users of the social services of the sheltered housing, through which I try to answer the research question whether and what effect has recovery of the legal capacity to the quality of the life of the users in the social services. This research pointed to the relation between the legal capacity, quality of housing and transformation in the social services, which form an important unit as a whole for the quality of the life of users in the social services. The results of this thesis will be used to improve the specific social services and will provide a feedback to the guardian and the management of the organization.
